Tennessee will appeal a federal ruling against the 2014 results of a constitutional amendment vote that limited abortion rights, the appeal puts on hold a recount of statewide votes cast during controversial contest. The state says the count approving the abortion limitation is valid. The appeal of last week’s decision by a federal judge ordering a recount says the amendment is a matter of state law to be determined by state courts. U.S. district judge Kevin Sharp says the vote count approving the anti-abortion action was unfair and violates the U.S. Constitution. His order requires state election officials to only count abortion amendment votes that include votes in the governor’s race as mandated by the Tennessee Constitution.
