An attorney representing a Manchester woman charged with murder in connection with the death of her newborn daughter is asking a judge to throw out the most serious count. Brittany Evans, age 28, is charged with 2nd degree murder in connection with the April, 2015 death of her child. She also is charged with 2 counts of aggravated assault in connection with the death. Defense attorney John Nicoll last week moved for dismissal of the murder charge, claiming it over-reaches state law. Prosecutors say Evans is responsible for the baby’s death due to the mother’s methamphetamine addiction. The baby died shortly after birth due to meth poisoning. The Tullahoma News reports Circuit Court Judge Vanessa Jackson will rule on the motion to dismiss the murder charge. Evans is held in the Coffee County jail under a $50,000 bond.
